1.2. Any term beginning with a capital letter is defined by express reference in this Privacy Policy. To the extent possible due to the context, words in the singular are to be interpreted in such a way that they also include the plural and vice versa.
1.3. Where reference is made to specific laws or regulations, such reference shall include any amendment, replacement or repeal of such laws or regulations, including any related executive decisions.
1.4. HDHIEU reserves the right to modify, change or amend the Privacy Policy at its sole discretion and from time to time. Any such change, modification or addition will be communicated via the Website. If you do not accept the changes, modifications or additions, you must notify us by sending an email to info.de@hd.com . If we do not receive such an email from you within three (3) business days of the changes to the Privacy Policy being posted on our website, you will be deemed to have unequivocally accepted all such changes.
Types of personal data we process
2.1. Whenever you use our website, webshops and social media channels, we collect:

Purposes of processing
3.1. HDID processes your personal data in order to provide you with the information, products and services you request through the Website, by e-mail, telephone, fax, social media channels and webshops in a personalised and efficient manner.
3.2. HDID processes your personal data for marketing purposes, i.e. to provide you with targeted communications, promotions, offers and other advertising from HDID and selected partners.
3.3. Unless you are an existing customer who has already purchased similar goods or services from us and whom we wish to target with our own marketing material, HDID will only send you communications, promotions, offers, newsletters and other solicitations by email or other person-to-person electronic communication channels if you have expressly consented to receive such communications. Legal basis for processing your personal data
4.1. For the processing of your personal data under the conditions set out in section 3.3, HDID, as the controller, will ask for your consent.
4.2. The processing of your personal data for the purpose of fulfilling an order that you have placed through one of our webshops is necessary for the performance of the contract between you and HDID.
4.3. The processing of your personal data for the purposes set out in clauses 3.4 and 3.5 is necessary for HDID to comply with its legal obligations.
4.4. The processing of your personal data for the purposes set out in clauses 3.1, 3.6, 3.7 and 3.8 is necessary for the purposes of HDID’s legitimate interests, which are:
- Continuous improvements to HDID’s website, webshops, social media channels, products and services to ensure you have the best experience possible;
- Keeping our website, webshops, social media channels, products and services that are protected from misuse and illegal activities;
- Marketing and advertising for our products, services, brands and overall successful marketing of our products and services.

However, we will ensure that all Hyundai Infracore group companies take due care to ensure that all processing of your personal data is carried out in accordance with the terms of this Privacy Policy.
Location and transfer
6.1. HDID processes your personal data primarily within the EEA. However, in order to process your personal data for the purposes set out in clause 3, we may also transfer your personal data to other companies within the Hyundai Infracore group or to third parties who process on our behalf and are located outside the EEA. Any company outside the EEA that processes your personal data is required to comply with appropriate safeguards in relation to the processing of your personal data. These guarantees result from the following:
- The beneficiary country has legislation that can be considered equivalent to the protection offered in the EEA; or
- From a contractual agreement between HDID and this institution. All HDID entities are parties to a contractual agreement based on the European Commission’s standard contractual clauses (controller-to-controller) (Commission Decision C(2004)5721.
6.2. HDID may transfer anonymised and/or aggregated data to organisations outside the EEA. Should such a transfer take place, HDID will ensure that safeguards are in place to safeguard the security and integrity of your data, as well as any rights in relation to personal data that you may have under applicable mandatory law.
Quality assurance
7.1. HDID will make its best efforts to process only such personal data as is necessary to achieve the purposes set out in Section 3.
7.2. Your personal data will only be processed for as long as it is necessary to achieve the purposes listed in Section 3 of this Privacy Policy or until you withdraw your consent to the processing. Please note that the withdrawal of consent may mean that you can no longer use the website, webshops, social media channels and other communication channels in whole or in part. HDID will de-identify your personal data when it is no longer necessary for the purposes set out in clause 3, unless:
- An overriding interest of HDHIEU, your financial institution, payment service provider or other third party in the identifiability of your personal data;
- A legal or regulatory obligation, or a court or administrative order, that prevents HDHIEU from anonymizing it.

This means that HDID will build a profile of you based on relevant characteristics as described in clause 2 and then use that profile to provide you with communications, promotions, offers, newsletters and other advertisements about products and services that may interest you.
7.4. HDID takes appropriate technical and organisational measures to protect your personal data against unauthorised access or theft, as well as against accidental loss, manipulation or destruction. Access by HDID employees or our external processors is only on a need-to-know basis and is subject to strict confidentiality obligations. However, they understand that safety and security are only obligations to the best of our ability that can never be guaranteed.

Your rights

9.2. You have the right to request that any personal data concerning you that is inaccurate be corrected free of charge. If a request for rectification is made, the request must be accompanied by proof that the data for which the correction is requested are incorrect.
9.3. You have the right to withdraw your previously given consent to the processing of your personal data, in which case Clause 8.4 will apply.
9.4. You have the right to request the deletion of personal data concerning you if it is no longer necessary with regard to the purposes set out in section 3 or if you withdraw your consent to the processing. However, you must keep in mind that a cancellation request will be considered by the HDID against:
- overriding interests of HDID, your financial institution, payment service provider or other third parties;
- Legal or regulatory obligations or official or court orders that may preclude such deletion.
Instead of erasure, you can also request that HDHIEU restrict the processing of your personal data if (a) you contest the accuracy of such data, (b) the processing is unlawful or (c) the data is no longer needed for the purposes set out in paragraph 3 but you need it to defend yourself in legal proceedings.
9.5. You have the right to object to the processing of personal data if you can demonstrate that there are serious and legitimate grounds related to his particular circumstances that justify such an objection. However, if the intended processing is to be classified as direct marketing, you have the right to object to this processing free of charge and without justification.

HDID will notify you immediately of receipt of this request. If the request is found to be justified, HDID will comply with it as soon as reasonably practicable and no later than thirty (30) days after receipt of the request.
If you have a complaint about the processing of your personal data by HDID, you can contact HDID at any time via the email address provided in this clause. If you are not satisfied with the response from the HDID, you are free to lodge a complaint with the relevant data protection authority.
